An unemployed factory worker who was convicted for riding a motorised scooter on a pavement is taking his case to appeal.

 

Philip Coates, 52, of Park Avenue, Cudworth, was found guilty of riding the £5,000 Segway on a pavement on Pontefract Road in what could prove to be a test case.

 

After his conviction Philip said he was considering appealing the case but feared the cost of doing so may stop him going ahead. But his solicitor, Victoria Molloy, has confirmed the case will go to the High Court and the appeal should be heard in Leeds next month.

 

At Barnsley Magistrates' Court in January district judge Michael Rosenberg ruled the battery-powered Segway which has a top speed of 12mph was a motorised vehicle and therfore could not be used on the pavement.

Philip was fined £75, ordered to pay £250 costs and a £15 victim surcharge.
